Bulgaria refuses to extradite Iva Mihailova over fatal crash
Sofia cites its constitution, while North Macedonia’s arrest warrant remains active in Kocani.
Bulgaria says it will not extradite Iva Mihailova, a dual Bulgarian and North Macedonian citizen, despite an arrest warrant tied to a fatal traffic crash in North Macedonia.
Interior Ministry officials said on October 14 that Bulgaria does not hand over its own citizens and that it took no steps to locate Mihailova, 23, because Interpol has not issued a red notice.
Mihailova is on trial before the Kocani Court over a traffic accident in which one person died. She is charged under Article 300, paragraph 4 and Article 297, paragraph 3 of North Macedonia’s Criminal Code.
The court issued the arrest warrant on October 13. Macedonian authorities asked Interpol to arrest and extradite her after she was summoned into the case.
Macedonian agency MIA reported that Mihailova turned up in Bulgaria over the weekend, and EuropeCrime previously covered how she claimed she crossed the border legally. Bulgaria confirmed it received the Interpol request to arrest and extradite her, but said it has not tried to establish where she is because Interpol has not escalated the case to a red notice.
In its explanation, Bulgaria pointed to Article 25, paragraph 4 of its constitution, which bars the surrender of Bulgarian citizens unless a ratified treaty allows it, and to Article 6, paragraph 1a of the European Convention on Extradition, which lets states refuse extradition of their nationals.
Bulgarian-Macedonian tensions flared after Mihailova’s reported departure. Macedonian officials urged Bulgaria to respect the warrant and extradite her, warning it undermined trust and interfered with the work of the judiciary. As of October 14, Mihailova remained outside the jurisdiction of the Kocani proceedings, which continued in her absence.
