A former police officer, Derek McNee, has been jailed for seven years after raping a sleeping woman in East Dunbartonshire in 2025. McNee, 43, was sentenced at the High Court in Glasgow after previously admitting the rape charge. Judge David Young KC ordered McNee to be monitored for 18 months after release. Police caught McNee after finding four incriminating videos on his mobile phone. Prosecutor Ruaraidh Ferguson told the court the videos showed McNee performing sexual acts while the woman was clearly and obviously intoxicated, including one clip where she was unresponsive throughout. Judge Young said there could be no free agreement when someone is incapable of giving consent. The judge also heard from two victim impact statements describing the woman’s “misery” and that she remained affected. McNee had worked as a police officer for seven years before running a dog grooming business in Paisley. He also admitted harassing another woman between 2021 and 2025 in Glasgow and Paisley, forcing her to change her phone number after he discovered it and contacted her almost 30 times in two days. He further admitted possessing a stun gun after a search of his car in August 2025. He was put on the sex offenders register and banned from contacting or approaching the victims for an indefinite period. The court was told McNee asked the sleeping woman if it would “arouse” her if he “did things” when she was asleep, and he later sent her footage he had recorded, after she asked him to delete it. At sentence, the High Court dealt with both the rape and the related admissions, after McNee had previously pleaded guilty. He is now serving his seven-year term and will face 18 months of monitoring after release.
