Garda charged with corruption faces Longford trial expected in April
Brian Carroll seeks a separate trial from fellow accused Sergeant James Muldowney.
A Garda accused of corruption-related offences is expected to face trial at Longford Circuit Court in April.
Garda Brian Carroll, 42, appeared before Judge Kenneth Connolly at the court hearing on Thursday, where the court was told he wants a separate trial and will return to Longford on December 1.
Carroll is charged with disclosing confidential information on September 9, 2021 to another individual at Esquires Coffee in the N4 Axis Centre, Longford.
The charge alleges he obtained the confidential information in the course of his duties and knew the disclosure was likely to have a harmful effect. He is also charged with perverting the course of justice, after it is alleged he intentionally damaged his mobile phone before a Garda search of his home at Ballinaboy, Kilteevan, on March 16, 2022.
Carroll is co-accused with Sergeant James Muldowney, 47. Muldowney is charged with stealing property, namely a quantity of cash, at a property in Ardnacassa on September 29, 2021.
He is also charged with using harm, threatening, menace, intimidating or putting fear in another person with the intention of causing an investigation or the course of justice to be obstructed or interfered with.
Defence barrister Niall Flynn asked for an adjournment until December 1 and for a pre-trial hearing date to be set so Carroll can sever his trial from Muldowney. Flynn said he understood the co-accused also intends to lodge a separate-trial application.
Judge Kenneth Connolly said the court must first determine the State’s attitude to severance before deciding whether separate trials are appropriate.
