The Bucharest Court of Appeal will rule on Friday on a DIICOT appeal in the case of Călin Georgescu, deciding definitively whether the preventive detention will stand. Judges will examine DIICOT’s challenge to a decision by the Bucharest Tribunal that replaced preventive arrest with house arrest for 30 days. The ruling will be delivered after the Court of Appeal reviews the appeal. Georgescu is being tried in a case alleging fraud involving an alleged scheme targeting a businessman from Buzău. The prosecution claims the alleged prejudice would exceed 1 million euros. The Tribunal’s decision to switch the preventive measure was based on the assessment of risk and Georgescu’s conduct during the investigation. The court said he did not leave Romania despite having the chance to do so and that he returned and showed up to judicial summons after coming back. In the legal reasoning for changing the measure, the Tribunal also noted that in other proceedings involving Georgescu there was no preventive measure in place at that time. It said there were no indications that he had previously avoided calls from the judicial authorities or failed to comply with obligations during earlier control. On Friday, the Bucharest Court of Appeal will deliver the final decision on whether Georgescu remains under preventive arrest or is placed under house arrest.
