TЦК and police set new rules for checks of men at addresses
Administrative detention can last no more than three hours under the joint order.
ТЦК and police have introduced new, joint rules for how officers act when they find violations of military registration or mobilization law.
The procedure covers checks on the street, in parks and squares, at workplaces, at checkpoints and border crossing points, and at the person’s place of residence. A joint order also sets limits on administrative detention and how it must be carried out.
Under the document, administrative detention can last no more than three hours from the moment a person’s freedom is actually restricted.
It also clarifies roles: police officers carry out the detention, not TЦК representatives. The order calls for joint notification groups, where the senior of the group is a TЦК representative, while the direct detention is performed by police.
Police can check documents and information about whether the person is on the wanted list when requested by TЦК. TЦК representatives check military registration documents and can hand over summonses.
If an administrative offence is identified, police can detain the person under the law. During detention, police must follow the prescribed procedure.
After detention, the person must be taken to a designated TЦК. That can be the nearest center for recruitment, the TЦК at the person’s registration address, or the center in the area where the violation was found. TЦК representatives may accompany the detained person, but they are not allowed to transport him to the recruitment center on their own.
Once the person arrives at the TЦК, the data are checked through the “Оберіг” register. TЦК also issues a delivery certificate, which does not replace the administrative detention protocol that police prepare.
The order further requires daily monitoring of the number of detained and delivered citizens, with police and TЦК comparing their figures and reporting the results to management, according to the reporting by 0352.ua.
Legal status: Investigation into the enforcement procedure is ongoing as the rules take effect.
